Cohabitation Agreement | Living Together Agreement Update
I’m pleased to announce that we have just updated the DL Guide that comes with both of our Cohabitation Agreements (for Ontario).
First, we removed references to the Common Intention Resulting Trust Doctrine (as discussed in a previous blog post, the Supreme Court has rejected this doctrine when dealing with property claims in the family law context).
Second, we added some more cases that discuss the matrimonial home and the court’s general approach to cohabitation agreements.
The bottom line is that the laws change every so often and we’re trying to have the most up-to-date and accurate information on this website. Mind you, it’s not always possible to have the most current information and you’re cautioned to always do your own diligence and seek professional legal advice for your specific circumstances.
