This is part 4 of 5 of the videos that were recorded from my presentation to the 4th year U of T dental students (April 27, 2011). If you want to know more about the arsenal of techniques and arguments that lawyers use to challenge restrictive covenants and other terms in an agreement, then just watch this video:

In the first part of the presentation, we discussed some of the differences between being an associate independent contractor vs. an employee. In the second part of the presentation, we discussed oral agreements and whether they are enforceable. In the third part of the presentation, we chatted about restrictive covenants and whether they are enforceable. In this part, we talk about challenging restrictive covenants. In the final part of our presentation, we will address a number of questions raised by students – such as terminating an agreement (make sure there’s a way out!) and making changes to an existing agreement!
